The Chhattisgarh High Court at Bilaspur has issued notice to the state government on a petition filed by former Salwa Judum personnel who were later absorbed into the Chhattisgarh Armed Police Force. The division bench of Chief Justice Krushna Ram Mohapatra and Justice Santosh Sharma gave the state six weeks to file its reply. The order was reported on October 19.<\/p>\n
The petitioners are represented by Advocate Fatesh Kumar Sahu, who practises before the Supreme Court, and Advocate Vidyabhushan Soni of the High Court. They allege unequal treatment and ask for fair consideration of their rights and benefits in service.<\/p>\n
The issues raised concern service benefits, alleged discrimination and equality in public employment under Articles 14 and 16 of the Constitution.<\/p>\n
Some background helps explain the case. Salwa Judum began around 2005 as an anti-Naxalite movement in Bastar, and many local youths were appointed as Special Police Officers. In 2011 the Supreme Court barred the use of such officers in anti-Naxal operations. Many of those who had served were later taken into the Chhattisgarh Armed Police Force.<\/p>\n
The High Court has so far only sought the state's response and has not given any finding on the merits. The report does not mention a date for the next hearing. The case will turn on how the state explains its service rules for the petitioners and on whether the court finds that they were treated differently from others in comparable posts.<\/p>\n
A notice at this stage only asks the state to respond. It is not a ruling on the merits of the claim, and the court will decide the matter after hearing both sides.
