The Chhattisgarh High Court, sitting at Bilaspur, has put conditions on an appeal filed by the owner of a Punjab Roadways bus against a compensation award of about \u20b91 crore in a fatal road accident case. The order, passed by a bench led by Justice Sanjay Kumar Jaiswal, was reported on October 12.<\/p>\n
The case arises from a road accident on October 14, 2019, in which one person died. The victim's family sought compensation from the Motor Accident Claims Tribunal, which on February 22, 2025, awarded \u20b91,00,09,160 along with 6 percent annual interest.<\/p>\n
The bus owner appealed against the award but filed the appeal 389 days late and asked the court to condone the delay. The High Court excused the delay so that the appeal could be heard on its merits, observing that the claimants had not yet received any compensation.<\/p>\n
The court did, however, attach conditions. The company must pay \u20b938,000 in costs, by cheque, to one of the claimants through the tribunal within 30 days. To obtain interim relief, it must deposit 50 percent of the compensation within 30 days; recovery of the remaining amount is stayed only once that deposit is made. Receipts for both payments must be filed at the next hearing.<\/p>\n
The claimants may withdraw the deposited money but must give a written undertaking to return it if the High Court later orders so. Fresh notices are to be issued to the other parties, including the bus driver, and the appeal will go forward.<\/p>\n
Such conditions are meant to balance the right of an appellant to be heard with the need to protect families who have waited years for compensation. The final decision on the amount will be taken only after the appeal is heard in full.<\/p>","protected":false},"excerpt":{"rendered":"
